(Hedging because we have no idea whether he was trying to blow through the protesters or if he just took a wrong turn on a closed highway and really didn't know where he was or what to do.)

Reading this article just makes me feel even more confident that there might well be a sizable gap in our statutes/common law mix wherein "engaging in dangerous behavior towards a specific person" is not considered murder.
I was unaware of the State v. Grigsby precedent however. That certainly makes 2nd degree murder charge more tenable.
